The Supreme Court on the DWI Exception to the Constitution

Attorney Competence, Ethics & the Globalization of Legal Practice

Many business, economic, and legal trends drive attorneys to adopt and expand international perspectives in their practices. These trends simultaneously heighten the ethical mandate that attorneys be competent to serve and advise clients on transnational legal matters.

Global economic integration and worldwide markets; the rampant popularity and ubiquitous nature of online businesses, e-commerce, and social networks; rapid advances in telecommunications and other technologies; and increasingly multinational and globally distributed workforces are just a few of these trends.

Add to these trends the rapidly-evolving and voluminous bodies of international and foreign domestic laws and of influential international soft law. Add to these the number and range of international and foreign legal regimes and the development of the rule of law worldwide.

These trends mean that virtually every legal practitioner has been or will be asked to represent clients on matters involving or impacted by international or foreign domestic law or both. These trends drive an urgent need for attorneys to ensure that they competently handle transnational legal matters in accordance with their ethical obligations.

The state and other Rules of Professional Conduct that govern attorney ethics require that, for each transnational legal matter, attorneys must ensure that they have or can obtain the requisite international legal education and skills and that they exhibit the thoroughness and preparation reasonably necessary to the matter. See, e.g., American Bar Association Model Rule of Professional Conduct 1.1 and comments.

Whether attorneys act reasonably in a particular transnational legal matter depends upon a comparison to the broader community of reasonably prudent and competent international legal practitioners. See Rule 1.0(h); Rule 1.1 & comment 5. Among the broader required areas of competence are international law, foreign domestic law, conflict of laws, and comparative international law.

Association with competent international attorneys and partnering with foreign attorneys are among the avenues to ethical competence in transnational legal matters available to practitioners.

Licensing Software in Global Markets

Online distribution and other globalizing factors make software licensing one of the most intricate and interesting types of intellectual property transactions.

I presented on International Software Licensing in San Francisco by invitation at the American Conference Institute's 14th Annual Software Licensing Conference.

Among other topics, my presentation illustrates the vital importance of strategic intelligence in controlling intellectual property rights flow in international software licensing deals.

I also discuss ways to harmonize licensing contract terms across multiple jurisdictions. These harmonized terms increase the efficiency and effectiveness of reducing legal risk and avoiding conflicts and litigation in international software licensing transactions.

Finally, I highlight the legal and business significance of some 2400-plus dual taxation treaties governing international intellectual property licensing. Among those considerations are the appropriate management of exposure to foreign taxing jurisdictions and the repatriation of maximized net royalty incomes to the licensor's home jurisdiction.

Loza's Paper on Violent Video Games Makes Top 10 List

SSRN has named my paper, "Video Software Dealers Association v. Schwarzenegger: A Rising Ninth Circuit Case on the Constitutionality of States' Regulation of Minors' Access to Violent Video Games," to its Top Ten download list for constitutional issues.

The paper was published last year in The Computer and Internet Lawyer.

SSRN (Social Science Research Network) is a leading Web site for academic publications. Cybersquatting on Social Networks - Register Your Trademarks Today!

In lay person's terms, cybersquatting is the use of a domain name that infringes another's trademark rights.

An example: Company C has federally protected rights (read, a registered federal trademark) in the words "Coca Cola," and Company B abusively registers an Internet domain name, cocacola.net. Here, trademark infringement creates the likelihood that consumers will be confused as to the source of Company C's goods and services. In this example, a consumer may visit the cocacola.net Web site where she or he expects to see information about how to buy Coca-Cola beverages and other products. This confusion harms the federally-protected Coca Cola brand.

There is more to cybersquatting and trademark infringement, of course, but these are the basic ideas behind the federal Anticybersquatting Consumer Protection Act and trademark protection generally. (Here's a USPTO backgrounder in its Report to Congress on the ACPA.)

Enter Facebook, LinkedIn, MySpace, and other social networking sites.

A concern has developed where users may be creating social networking profiles with "names" that may cybersquat on others' protected brands.

Facebook just announced on Wednesday (June 10th) that it will begin providing access to vanity URLs tomorrow (June 13th, 12:01am). (This means that a user's Facebook URL can read <http://www.facebook.com/username>, instead of a random number-based URL.) These vanity URLs will be available on a first-come, first-serve basis.

Facebook explains that this new vanity URL service will make it easier to locate FB pages. There is a serious concern, however, that this will open the doors for a flood of trademark infringers and cybersquatters.

To address this concern, FB is giving holders of federally-registered trademarks owners the opportunity to block requests for URL extensions using their marks.

To register your registered mark with FB, take this simple steps NOW before the vanity URL gates open just after midnight tomorrow:

1. Go to http://www.facebook.com/help/contact.php?show_form=username_rights.

2. Complete the simple form. (You'll need your trademark registration number at hand.)

3. You'll receive a submission acknowledgment email from FB.

4. FB will then examine your submission and, if approved, will withhold your mark from the public reservation process that begins tomorrow.

Be ahead of the curve and get your mark registered today.

Supreme Court Denies Review of Cyberspace Privacy Case

The United States Supreme Court has declined to take up an appeal in Sodomsky v. Commonwealth of Pennsylvania.


The original challenge brought by Sodomsky sought to suppress evidence of child pornography found on his computer.


Sodomsky had taken his computer to Circuit City to have a DVD burner installed. The technician doing the work encountered the files, including multiple video files, on Sodomsky's computer. The technician reported the matter to the authorities who then sought to prosecute Sodomsky.


On appeal, the Pennsylvania Superior Court reversed the lower court, which had held that the files were inadmissible.


The Court stated, "If a person is aware of, or freely grants to a third party, potential access to his computer contents, he has knowingly exposed the contents of his computer to the public and has lost any reasonable expectation of privacy in those contents." See 939 A.2d 363, 369 (Pa. Super. Ct. 2008) (emphasis supplied).

The Pennsylvania Supreme Court agreed with the Superior Court's decision, and the U.S. Supreme Court has declined to review the ruling.

Loza to Appear in Social Media Series Targeting High Tech Entrepreneurs

Indiplex Media Solutions, an innovative digital media content services company, is creating a social media series for entrepreneurs. This entrepreneurship series takes a early lifecycle approach and focuses on key strategic planning considerations from start-up to early stage.

Emile Loza, TLG's founder and an intellectual property (IP) strategist, will appear in a video interview for the series to answer IP questions specific to high tech start-ups.

The two images below show web traffic to our county court site and to my Albany restaurant review blog. They come from Google Analytics. Google Analytics Quirk

Maybe I'm not as good at math as I thought. How can I get only 7000 visits from over 10,000 keywords? See image below from Google Analytics.Okay, so after I started posting this, I figured out what happened. On the above image, I had it set to compare to a previous period. I think it counted the keywords from both periods. Once I unchecked the "compare to past" box, it came down to 5690 keywords.

Traffic Court - New Milestones

Our traffic court site has cleared some new hurdles. We not only surpassed 100,000 visits in 31 days. We've hit 130K visits, and over 114,000 unique visitors. We also cleared 300,000 pageviews. Big news in Albany - this past weekend had a "blanket patrol" per Capital News 9.Nice bit from the story - 944 traffic stops and 21 "drunk driving" arrests. NY DWI: Why low BAC cases should be fought

I got a call the other day from a prospective DWI client. His BAC was 0.16. It's already difficult in Albany to negotiate a reduction with a BAC that high. But it's worse than that. Oklahoma Playing Dirty

Just a quick hit on the Florida-Oklahoma game. Oklahoma is playing dirty. There was a horse-collar tackle on a FL running back (#3) - no call and it took him out of the game. A wicked facemask on Demps (FL #2) as he neared the end zone - called but just a nasty facemask.
